TPS Registration for Honduras Now Open

Last week, USCIS issued an important announcement pertaining to TPS for Honduras. The re-registration procedures have been officially published in the Federal Register, and those wishing to maintain their status through January 5, 2020 (the effective termination date of TPS for Honduras) must get their re-registration forms in between now and August 6, 2018.

As part of the re-registration process, applicants must complete and submit Form I-821. Additionally, if an individual wishes to work, he or she must also complete and file Form I-765. Due to the inevitable processing delays, USCIS has fortunately automatically extended the expiration date of current work permits for Honduran TPS holders through January 1, 2019. This will include applicants whose current employment authorization documents expire on January 5, 2018 and who have applied to renew their work permits during the last re-registration but have not yet received their new work permits.

The important thing to remember is that TPS merely confers temporary protected status. It was never intended to be permanent and will, unless the government has a miraculous change of heart, expire for good on January 5, 2020. Those who currently have TPS would be well advised to renew their status-assuming that there have been no material changes or circumstances that would potentially render them removable and endanger their status. At the same time, TPS recipients need to explore what other options are available. In some cases, individuals with TPS may now be eligible to apply for permanent residence. For example, there are people who may have initially entered the country without inspection but subsequently traveled with TPS advance parole and have an Immediate Relative who can file for them. In some jurisdictions, such as the Sixth and Ninth Circuits, the TPS status is even considered a form of inspection which may enable some applicants to apply, despite entering the country without permission, even if they haven’t traveled with advance parole.
