Deferred Status Forms Finally Available For Childhood Arrivals Or “Dreamers”
USCIS has finally released the official form that applicants must use to apply for Deferred Action Status as a Childhood Arrival or “DREAMER.” The Form is the I-821D, which must be filed in conjunction with the I-765 and I-765WS (Worksheet). Requests must be submitted with the appropriate filing fee of $465 and relevant evidence documenting eligibility. It is important to understand that requests are not granted automatically. Each case will be judged on a case-by-case basis before the government decides to exercise its discretion not to enforce deportation or removal against the applicant. Applications need to be filed correctly and done completely, as there is no appeal of USCIS’s determination.
